This Policy applies to teleconsultations facilitated through the OPLive Application. It does not apply to Home OP or Clinic OP bookings, which are physical consultations governed by standard professional regulations.
OPliveHealth Private Limited acts solely as a technology platform facilitating teleconsultations between Users and independent Registered Medical Practitioners ("RMPs"). OPLive does not practise medicine, provide medical advice, diagnose diseases, prescribe medicines, or interfere with the independent professional judgment of any RMP. All clinical decisions, diagnoses, prescriptions, referrals and treatment recommendations remain the sole responsibility of the concerned RMP.
| Practitioner Category | Permitted Teleconsultation Services & Rules |
|---|---|
| Registered MBBS Doctor | All teleconsultation modes. Schedules H and H1 with documentation. Schedule X — PROHIBITED via teleconsultation. |
| Specialist / Super-specialist | Within registered area of expertise only. |
| Dental Surgeons (BDS/MDS) | Oral health consultations only. Oral medications only. |
| AYUSH Practitioners | Within their registered system only. Allopathic prescriptions strictly prohibited. |
OPLive shall implement reasonable technical and organisational measures, including encryption and appropriate security controls, to protect teleconsultation communications, subject to technological limitations, maintenance activities and circumstances beyond OPLive's reasonable control. The RMP's name, qualification, and registration number must be displayed prominently before each session.
The Application must capture and transmit to the RMP: patient name, age, gender, and city/state. Where required by applicable law, regulatory guidance or clinical necessity, OPLive or the RMP may request appropriate identity verification before or during the consultation.
OPLive shall implement reasonable system controls designed to assist Registered Medical Practitioners in complying with the applicable Telemedicine Practice Guidelines and other applicable laws. Such controls are intended solely as compliance aids and shall not replace, modify or diminish the independent professional responsibility of the Registered Medical Practitioner for issuing lawful, appropriate and clinically justified prescriptions.
Where technically feasible, the Application shall prominently display the national emergency helpline (112) on teleconsultation screens. In any medical emergency identified during a consultation, the RMP shall advise the patient to contact emergency services immediately and seek treatment at the nearest appropriate healthcare facility.
Every digital prescription must contain the patient's full name and age, date, drug name (generic preferred), dosage, route, frequency and duration, and the RMP's full name, qualification, designation, registration number and digital signature. Where implemented by the Platform, digital prescriptions may also include a unique consultation reference generated by OPLive for administrative and record management purposes.
OPLive designates a Platform Compliance Officer (PCO) responsible for monitoring Telemedicine Guideline adherence.
PCO: Dr. Ragesh S | Email: compliance@oplive.app
Where repeated non-compliance is identified, OPLive may issue warnings, require corrective measures, suspend, restrict or remove the RMP's access to the Platform in accordance with applicable agreements and internal policies as per Practitioner Agreement.
This Policy is reviewed annually and updated to reflect changes in the Telemedicine Guidelines or applicable laws. Updated Policy communicated to all listed RMPs.
Nothing contained in this Policy shall be construed as creating a doctor-patient relationship between OPLive and any User. OPLive shall not be responsible for any medical opinion, diagnosis, prescription, treatment, clinical outcome or professional negligence of an independent Registered Medical Practitioner. OPLive's responsibilities are limited to operating and maintaining the technology platform in accordance with applicable law.
OPLive reserves the right to amend this Policy from time to time to reflect changes in applicable law, regulatory requirements, technology or business operations. The revised version shall become effective from the Effective Date specified therein.
